Comerx GmbH, Stallikon

1. General

These General Terms and Conditions (GTC) form the basis for a fair customer relationship.
By submitting an order, the customer agrees to the GTC.

2. Scope of application

The GTC govern the business relationship between Comerx GmbH, C/O Damir Veljaca, Langfurenstrasse 10, 8143 Stallikon and you as a customer of Comerx GmbH. Deviating agreements must be made in writing to be valid.

Our offers are aimed at customers within Switzerland and the Principality of Liechtenstein.
Comerx GmbH reserves the right to change these GTC at any time; the version of the GTC valid at the time of the order is decisive.

3. Conclusion of contract

Our offers are subject to change and are to be understood as a non-binding invitation to conclude a contract; availability, prior sale and price changes are expressly reserved.

All orders shall only be deemed to have been accepted by us upon our written order confirmation or upon delivery of the invoice.

4. Prices and price quotations

Our prices are quoted in Swiss francs, excluding the legally applicable value added tax.
Price changes and time-limited promotions are possible at any time and require no prior notice. Stock levels after price changes will not be compensated.

5. Packaging and transportation costs

Packaging units are defined per item, but can also be customized on request. Additional packaging and handling costs may be charged separately.

Dropshipping services are offered, the delivery costs shall be borne by the business customer unless otherwise agreed. Deliveries are only made within Switzerland and the Principality of Liechtenstein. Deliveries abroad are not offered.

Minimum order quantities or minimum order values are agreed individually. Transportation costs shall be borne by the customer, unless otherwise agreed.

We reserve the right to charge additionally for further logistical services such as express delivery etc. 

6. Collection

In the case of collection from the Comerx GmbH warehouse, C/O Damir Veljaca, Langfurenstrasse 10, 8143 Stallikon, we ask you to notify us by telephone at least 48 hours in advance.

7. Delivery times

The delivery time is usually two to three working days, provided that the ordered quantities are available from stock in Switzerland; however, this delivery time cannot be guaranteed. Claims for damages due to late delivery, partial delivery or non-delivery are excluded. This also applies to agreed fixed dates. There are no shipping costs for collection.

8. Warranty

The condition of the goods received must be checked immediately upon receipt; after five working days the delivery is deemed to have been approved.

For justified defects reported in writing, a subsequent or replacement delivery shall be made free of charge. Hidden defects will be replaced or credited if returned immediately, provided they are not caused by usage or handling errors.

We adhere to the legal requirements or the manufacturer’s warranty.

9. Payment

Payment of the purchase price can be made either by invoice or bank transfer. Discounts or partial payments will not be accepted. General terms of payment are 15 days net from delivery of the goods, unless otherwise agreed.

In the event of late payment, we expressly reserve the right to claim the statutory default interest; a flat-rate fee of CHF 20.00 will be charged per reminder.

10. Place of jurisdiction and applicable law

Swiss substantive law shall apply exclusively, to the exclusion of the provisions of the Convention on Contracts for the International Sale of Goods (CISG). The exclusive place of jurisdiction is Zurich.
